Privacy Policy
Effective date: 06 August 2026 — Version 3.0
1. Who we are
This Privacy Policy explains how Benjamin Samuel Waelend trading as Migration Match (ABN 97 952 314 453) ("Migration Match", "we", "us", "our") collects, uses, holds, discloses, and safeguards your personal information.
Migration Match is bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). We also comply with the Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth) in all commercial communications.
2. Scope of services & legal disclaimer
2.1 Referral and introduction service
Migration Match operates an introduction service connecting individuals seeking Australian visa assistance with independent Australian law firms and registered migration agents. Migration Match is not a law firm, legal practice, or registered migration agency.
2.2 Educational information only
All content published or distributed by Migration Match — including website content, questionnaires, guides, checklists, and electronic communications — is general educational information only. It does not constitute legal or migration advice, nor does it assess your visa prospects under the Migration Act 1958 (Cth). Migration Match is not authorised or qualified to provide migration or legal advice.
2.3 Reliance on qualified practitioners
Information provided by Migration Match should not be relied upon to make legal or migration decisions. All decisions regarding visa applications, timing, eligibility, and correspondence with the Department of Home Affairs should be made in consultation with a qualified legal practitioner or registered migration agent who has formally reviewed your full circumstances.
3. Commercial model & fees
Our introduction service is provided to prospective clients at no charge.
Participating law firms and registered migration agents pay Migration Match a fixed administrative introduction fee when a referral is made. These fees vary based on the practice area and capacity of participating firms.
Matching is determined solely by your specific circumstances, geographic location, and the partner firm's area of practice. Migration Match does not auction leads, nor do we prioritise matches based on the commercial fees paid by a partner firm.
Fees paid to Migration Match are fixed administrative charges. We do not receive percentage splits, success fees, or commissions derived from professional legal fees billed by participating firms.
4. Anonymity and pseudonymity
Where practicable, you may interact with Migration Match anonymously or by using a pseudonym, such as when browsing our website or accessing general public resources.
To utilise our referral service, you must provide your verified full name and contact details (including mobile phone verification via SMS) to enable the matched law firm to contact you.
5. Collection notices and consent mechanisms
Prior to submitting an online inquiry, a clear Collection Notice is presented on the intake form detailing:
- Our identity and legal status as a referral service (and not a law firm or registered agency);
- That your submitted details will be passed to one matched law firm;
- That the law firm pays Migration Match a fixed fee for the referral; and
- That you will not be charged by Migration Match.
To submit an inquiry, you must actively complete separate consent actions:
- Referral consent: an explicit opt-in confirming your request to be introduced to a partner firm.
- Sensitive information consent: a separate, distinct opt-in required if you choose to disclose sensitive flags (such as criminal background or health conditions).
- Direct marketing consent: an optional opt-in that is never pre-selected. An inquiry can be submitted without consenting to marketing.
Migration Match records audit logs for every submission, including the exact wording shown, timestamps, IP address, and consented options. You may request a record of your submission log by contacting us using the details in Section 16.
If you exit our questionnaire without submitting, no entered data is retained or stored by our systems.
6. Categories of personal information collected
6.1 Information provided directly
- Identity & contact data: first name, last name, email address, and mobile number (verified via SMS passcodes).
- Eligibility circumstances: visa subclass interest, relationship status/duration, sponsor status, current visa status/expiry, age bracket, current location (onshore or offshore), and prior visa refusal or cancellation history.
- Sensitive complexity flags: indicative indicators regarding criminal records or health conditions that may impact visa eligibility. We collect only binary indicator flags (yes/no) and do not request or store specific medical histories or detailed criminal charge details.
6.2 Sensitive information
Under the Privacy Act 1988 (Cth), disclosures regarding health conditions or criminal histories constitute sensitive information. We collect these indicators solely to match you with a law firm possessing the relevant expertise and to inform the firm of the general nature of your inquiry.
Sensitive information is collected and transferred only with your express written consent. You may withdraw this consent at any time prior to referral delivery (see Section 14).
6.3 Automatically collected technical data
When accessing our website, we automatically collect technical metadata including IP addresses, browser specifications, device identifiers, referring URLs, session interactions, and form navigation logs via analytics tools and cookies (see Section 11).
7. Purposes of collection, holding, and use
Migration Match collects, holds, and uses your personal information to:
- Evaluate your general criteria and match you with an appropriate participating law firm or registered migration agent;
- Pass your inquiry details to one matched firm so they may contact you regarding a consultation;
- Verify contact details via automated SMS verification;
- Respond to customer service inquiries and deliver administrative notifications;
- Monitor, optimise, and analyse digital advertising and website performance;
- Deliver promotional communications (where optional marketing consent has been explicitly provided); and
- Comply with statutory, tax, legal, and record-keeping requirements.
8. Disclosure of information to partner firms
8.1 Exclusive disclosure model
Upon receiving your explicit consent, your inquiry details (including any sensitive indicators selected) are transferred to one participating firm in our network. That firm will contact you directly via phone, SMS, or email.
Migration Match does not broadcast, rent, or sell client data to multiple competing firms, data brokers, or third-party marketing networks.
8.2 Firm qualifications
Participating firms are evaluated for professional registration, active practising status, relevant immigration law experience, and client service standards. Migration Match does not supervise, direct, or guarantee the legal services provided by participating firms, nor do we share in legal fees billed to you.
8.3 Legal independence of partner firms
Once personal information is transferred to a participating law firm, that firm becomes an independent APP entity responsible for compliance under its own privacy policy, legal regulations, and professional conduct obligations.
9. Other third-party disclosures
We may disclose personal information to:
- Contracted service providers: cloud hosting vendors, CRM providers, SMS and email communication gateways, data analytics platforms, and professional IT services acting under binding confidentiality terms;
- Professional advisers: legal counsel, accountants, and auditors where reasonably necessary for business operations;
- Corporate successors: prospective purchasers or legal successors in the event of a business merger, acquisition, or restructuring; and
- Regulatory & law enforcement authorities: government or regulatory agencies where mandated or authorised by law, court order, or subpoena.
Migration Match does not sell, trade, or rent personal data to third parties for independent commercial use.
10. Overseas data transfers
10.1 Overseas recipients
To deliver our services, personal information may be processed by entities outside Australia:
- Cloud & technology infrastructure: data is securely stored in cloud data centres located in the United States and the European Union.
- Operational support: authorised administrative contractors located in the Philippines assist with IT support, technical auditing, and marketing platform maintenance under strict confidentiality agreements and restricted access protocols.
10.2 Statutory protections
Where data is transferred internationally, Migration Match takes reasonable steps to ensure overseas recipients comply with the Australian Privacy Principles pursuant to APP 8. Migration Match retains legal accountability for the protection of your personal information under the Privacy Act 1988 (Cth).
11. Cookies, analytics, and digital advertising
Our online services utilise tracking technologies to evaluate platform performance and manage advertising campaigns:
- Google Analytics: tracks website traffic patterns, conversion metrics, and user interaction.
- Meta Pixel & Conversions API: measures advertising conversion performance on Meta platforms (Facebook/Instagram). Contact identifiers (such as email addresses or phone numbers) are cryptographically hashed prior to transmission to prevent exposure of raw contact data.
- Microsoft Clarity: captures aggregated session analytics and interaction heatmaps to optimise user navigation. Form text inputs are automatically masked and remain invisible during session recordings.
You may manage tracking preferences or disable cookies through your web browser settings. Disabling essential cookies may impact website functionality.
12. Security and data breach notification
Migration Match maintains technical, organisational, and physical safeguards designed to protect personal information from misuse, loss, unauthorised access, modification, or disclosure. Safeguards include transit and at-rest encryption, access-controlled infrastructure, and multi-factor authentication.
In the event of a security incident resulting in an eligible data breach likely to cause serious harm, Migration Match will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) in accordance with the Notifiable Data Breaches (NDB) scheme under Part IIIC of the Privacy Act 1988 (Cth).
13. Data retention schedules
Personal information is retained only as long as necessary to fulfil operational, legal, or administrative requirements:
| Information category | Retention period | Post-retention action |
|---|---|---|
| Sensitive complexity flags (health & criminal indicators) | 12 months from introduction date | Permanent erasure from active database records |

- Deletion: request deletion of personal records, subject to statutory retention obligations.

15. Direct marketing communications
Migration Match issues marketing communications solely to individuals who have expressly opted in via our dedicated, un-ticked marketing consent checkbox.
